Abode Photo Co. (Emily Green) retains the copyright to all images. Your purchase is for a license to use the images. Standard limited usage license includes online promotional use (web and social media) and print collateral. The copyright of an image is not transferred to any other party unless a specific written agreement is made. Any rights granted are always non-exclusive and nontransferable. Sharing or selling images to a third party for use is strictly prohibited unless otherwise stated. Any use by a third party including, but not limited to, builders, architects, stagers, interior designers, new property managers, and new listing agents, is prohibited. If a third party wishes to use the images, a separate license, print release, or express written permission is required.
Copyright metadata contained within any digital file may not be altered or removed, without the express consent of Abode Photo Co. (Emily Green). Altering images, including, but not limited to, filters, additions, or subtractions, is not permitted.
Images published in magazines, books, or any other printed publication must receive permission from Abode Photo Co. (Emily Green) and must include photo credit to "Emily Green, Abode Photo Co."
Payment is due within 1 day after invoice is received. If the invoice is not paid within the 14 day grace period, a new invoice will be issued with an additional $25 late fee due immediately. Failure to pay for the images will result in a copyright infringement/violation and may result in legal action.
Abode Photo Co. reserves the right to use photographs for portfolio display, website content, social media, advertising, competitions, and other promotional purposes unless otherwise agreed to in writing prior to the photoshoot.
If circumstances beyond the photographer's reasonable control—including equipment failure, illness, accident, acts of God, or other unforeseen events—prevent the completion or delivery of the photoshoot, liability shall be limited to a refund of any fees paid for the affected services.
By hiring Abode Photo Co., the client acknowledges and agrees that all artistic and creative decisions, including, but not limited to, composition, camera angles, lighting, editing style, image selection, and delivery, are made at the sole discretion of the photographer.
While reasonable requests are welcomed whenever possible, Abode Photo Co. retains full creative control over the photographic and editing process. RAW or unedited images will not be provided.
Any cancellation or rescheduling within 4 hours of the photoshoot time or once the photographer has arrived will be subject to a $100 service/trip fee.
By scheduling a photoshoot, you affirm that the property will be clean, organized, staged (if applicable), and fully photo ready at the scheduled appointment time. Preparing the property is the responsibility of the client, homeowner, builder, or other responsible parties.
Abode Photo Co. is not responsible for digitally removing dirt, dust, stains, smudges, clutter, personal belongings, construction materials, landscaping issues, or other property condition concerns during the standard editing process. Requests for extensive object removal or additional retouching are subject to the photographer's discretion and may incur an additional editing fee.
You also understand that there will be a $100 service/trip fee charged when we must return to a property due to circumstances beyond the photographer's control. This includes, but is not limited to, the property not being ready, incomplete staging, ongoing construction, inaccessible lockbox, or other conditions preventing the completion of the photoshoot. If a partial shoot is requested due to select spaces being incomplete, the photoshoot fee may remain the same, and an additional fee will be charged for the return visit. Fees will vary based on the square footage of the property.

There will not be a fee to reschedule the photoshoot due to weather within 3 hours of the photoshoot time. Exterior photos cannot be guaranteed if rain is present. There may be an exterior shoot fee if the photographer is required to return to photograph exteriors at a later time or date due to rain. In the event of severe weather conditions, Abode Photo Co. retains the right to reschedule the photoshoot for the next available appointment time.
Properties that require paid parking will be subject to a parking fee. Parking fees vary.
Images are considered successfully delivered upon first delivery. Clients are responsible for downloading and backing up all delivered files. Abode Photo Co. does not guarantee long term archiving and may permanently delete image files at any time after delivery.
By confirming an appointment or accepting photography services from Abode Photo Co., the client agrees to these Terms of Service.
